John FAULL – Will
This is the last Will and Testament of me John FAULL of the parish of
Gwinear in the county of Cornwall, yeoman.
I Will, Order and Direct that all my just debts, funeral expenses and
the expenses of proving this my last Will and Testament shall be paid and
discharged as soon as can be after my death by my Executor hereinafter
named and I charge and make liable all my monies goods chattles estate
and effects with the payment thereof and subject thereto, I give and bequeath
as follows:
(Viz) I Give and bequeath unto my sister Susanna ELLIS the sum of one
guinea and to her children Mary and Richard the sum of five pounds each
to be paid in three months after my decease.
I Give and bequeath until my niece Elizabeth VINCENT, her Executors,
Administrators and Assigns all that my dwelling House now in my own occupation
situate in the said parish of Gwinear together with the barn, outhouses,
garden and cur?lage thereto belonging, and also the little meadow behind the
same. To hold the same unto the said Elizabeth VINCENT, her Executors, Administrators
and Assigns for all my estate and interest therein independent of her present,
or any future, Husband, but subject nevertheless to the payment thereunto
my sister Jane PALAMOUNTAIN for and during her natural life of one annuity,
or yearly sum, of five pounds by equal quarterly payments.
I Give devise and bequeath unto my said sister Jane PALAMOUNTAIN one
annuity, or yearly rent, charge or sum of five pounds to be paid and payable
to her and her assigns for, and during, her natural life, and I do hereby
charge and make liable the aforesaid Dwelling House and premises herein
before given to my niece Elizabeth VINCENT, with the payment of the same;
the said annuity to be payable and paid by quarterly payments, the first
payment to be made on the first general quarter day which shall happen next
after my death, and at all times to be recovered, if in arrears, by the same
means as are used in case of non-payment of rent – I also give and bequeath
until my said sister the sum of seventy pounds to be paid her within three
months after my death. Also I give and bequeath unto my sister Jane
PALAMOUNTAIN the Bedstead and Bedding now commonly used by her.
I Give and bequeath until my sister’s daughter Elizabeth COCK the sum
of Twenty pounds, the same to be paid to her by four annual payments In
trust to be laid out and expended by her, for the use of her children by
her late husband.
I Give and bequeath unto William VINCENT of Gwinear aforesaid all those
my two Dwelling Houses situate in Gwinear aforesaid on part of Berorral
now in the occupation of Edward SINCOCK and Edward MURLEY with the gardens
and appurtenances thereunto belonging. To hold the same for all my
interest therein In trust to receive the rents and incomes thereof and payment
apply the same equally towards the bringing up of his son William VINCENT
and William the son of my nephew William PALAMOUNTAIN, until the youngest
of them attains his age of fourteen years and then in trust as to Edward
SINCOCKS premises to hold the same for the sole use and benefit of his said
son William, and as to Edward MURLEYS premises In Trust for the sole use
of my said nephew William PALMOUNTAIN son William, and to assign and deliver
the same to them respectively on their respectively attaining the age of
twenty one years.
I Give and bequeath unto my niece Elizabeth FAULL the daughter of my
brother Henry FAULL my best Bedstead together with the Tye boulster pillows
and all the furniture and bedcloaths thereunto belonging and commonly used
therewith, also
I give her my silver milk cup and six silver meat spoons.
I Give and bequeath unto the aforenamed William VINCENT the sum of five
pounds for his own use.
I Give and bequeath unto my nephew Richard FAULL, the son of my brother
Henry FAULL the sum of one hundred pounds, fifty pounds thereof to be paid
at the end of six months after my death and the remaining fifty pounds
(without interest) to be paid him from the money due to me on the Bond
of Messrs Richard ROSEWARNE and William ROSEWARNE when the said Bond shall
become payable.
Also I give and bequeath unto my aforesaid brother Henry FAULL the sum
of three hundred pounds, one hundred and fifty pounds part thereof to be
paid him (but without interest) out of the money due to me on the Bond of
Messrs Richard ROSEWARNE and William ROSEWARNE when the same shall become
payable.
I Give and bequeath unto my nephew William PALAMOUNTAIN the sum of two
hundred pounds to be paid at the end of twelve calendar months next after
my death.
I Will, Order and Direct that all the remainder of my household furniture
and articles of household, earthenware, linen and glass and Also all my
farming stock and husbandry implements shall be sold and disposed of by my
Executor by public auction as soon as can be after my death, and the produce
thereof, after deducting the expenses attending on such sale, to be paid
and divided equally between my said Brother Henry FAULL and my said nephew
William PALAMOUNTAIN and my said niece Elizabeth VINCENT.
I Will and Direct that all wages due from me to my servant Mary CORIN
at the time of my death shall be paid to her as soon as possible. I also
give to her the sum of twenty shillings to be laid out in mourning.
I also give and bequeath unto the said Mary CORIN all those my cottages
and premises situate at Deveral within the said parish of Gwinear to hold
to her, her Executors Administrators and Assigns for all my interests therein.
I do hereby order and direct that each of my bearers shall have at the
expense of my Effects a Halband and a pair of gloves and each of them the
sum of five shillings and six pence.
All the rest residue and remainder of my Lands and Tenements goods and
chattles money and securities for money debts due and owing to me goods,
chattles and effects whatsoever and where sover the same may be situate and
lying not herein before given and bequeathed by this my Will but subject
as aforesaid I Give Devise and bequeath unto and among my aforesaid nephew
William PALMOUNTAIN and my said niece Elizabeth VINCENT in equal parts and
proportions share and share alike and I do hereby make, nominate, constitute
and appoint my said Brother Henry FAULL whole and sole Executor of this my
last Will and Testament hereby revoking all former and other Wills by me at
any time made and I do declare this and no other to be my last Will.
In Witness whereof I have to this my last Will contained in these sheets,
to the first two of which I have set my hand to this last and third sheet
have set my hand and affixed my seal this sixteenth day of March in the
year of our Lord one thousand eight hundred and thirty one,
