Charles FAULL - Will

Know all Men by these Presents that We Thomas CARDELL of the parish of Crowan in the county of Cornwall, yeoman and John DOBB the younger, and John KENDALL the younger, both of the Borough of Helston in the said county, yeoman are held and firmly bound unto the worshipful George MOORE Clerk Master of Arts Archdeacon of Cornwall in the sum of two hundred pounds of good and lawful Money of Great Britain to be paid unto the said George MOORE or to his certain Attorney his Executors Administrators or Assigns to which payment will and truly to be made. We oblige ourselves and everyone of us by themselves for the whole our and every of our Heirs Executors and Administrators firmly by these Presents, Sealed with our Seals dated the twenty sixth day of January in the forty second year of the Reign of our Sovereign Lord George the third, by the Grace of God of the United Kingdom of Great Britain and Ireland, King Defender of the Faith and so forth, And in the year of our Lord One Thousand eight Hundred and two.

The Condition of this Obligation is such That if the above bounden Thomas CARDELL being a principal creditor admitted Administrator of all and singular the Goods Chattles and Credits of Charles FAULL late of the parish of Redruth, deceased, Mary wife of John DAVIES, the eldest daughter and next of kin of the said deceased having under her hand and seal renounced her right to Letters of Administration of the Goods Chattels and credits of the said deceased, do make, or cause to be made, a true and perfect Inventory of all and singular the Goods Chattles and Credits of the said deceased which have, or shall, come to the Hands Possession or Knowledge of her the said Thomas CARDELL or into the Hands and Possession any Person or Persons for her and the same so made exhibit or cause to be exhibited into the Registry of the Archdeaconry Court of Cornwall at or before the last day of April next ensuing. And the same Goods Chattles and credits and all other the Goods Chattles and Credits of the said deceased at the time of his death which at any time after shall come to the hands or possession of the said Thomas CARDELL or into the hands and Possession of any other person or persons for her do well and truly administer according to Law. And further to make or cause to be made a true and just Accompt of her said, Administration at or before the last day of January 1802 and all the Rest and Residue of the said Goods Chattles and Credits which shall be found remaining upon the said Administrations Accompt the same being first examined and allowed of by the Judge or Judges for the time being of the said Court shall deliver and pay unto such Person or Person respectively as the said Judge or Judges by his or their Decree or Sentence pursuant to the true Intent and Meaning of a late Act of Parliament made in the two and twentieth and three and twentieth Years of the Reign of our Late Sovereign Lord King Charles the Second, entitled an Act for the better settling of Intestators Estates shall limit and appoint . And if it shall hereafter appear that any last Will and Testament was made by the said deceased and the Executor or Executors therein named do exhibit the same into the said Court making Request to have it allowed and approved accordingly if the said Thomas CARDELL above bounden being there into required do render and deliver the said Letter of Administration. Approbation of such Testament being first had and made in the said Court then this Obligation to be void or else to remain in full Force and Virtue.

Know all Men by these presents that I Mary DAVIES, the wife of John DAVIES of the parish of Crowan in the County of Cornwall, tinner, and also the eldest natural and lawful daughter and child of Charles FAULL late of the parish of Redruth in the said County, butcher, deceased, who died a widower and Intestate for divers good causes and considerations me hereunto moving, I have renounced and hereby do renounce all such right and title and I now have or can or may claim of in or unto the Administration of the Goods Chattles and Effects right and credits of the said Charles FAULL deceased and hereby refuse to take upon myself or accept Letters of Administration of the said Goods Chattels rights and credits but do hereby consent and desire that such Letters of Administration of the goods chattles rights and credits of the said Charles FAULL deceased may be granted to Thomas CARDELL of the parish of Crowan in the said County, yeoman, who is a principal creditor of the said Charles FAULL and that this my renunciation may have its due effect in law I do hereby constitute nominate and appoint Nicholas Wallis PENROSE and Hender MOUNSLOVEN?, gentleman. Notaries public and proctors of the Archdeaconry County of Cornwall or any other proctors of the said County my true? and lawful proctors and proctor jointly and severally for me and in my name to appear before  the worshipful George MOORE Clerk Master of Arts Archdeacon and Judge of the Court of the said Archdeaconry of Cornwall his Surrogate or other competent Judge in his behalf and desire and obtain this renunciation to be admitted and enacted and to do and perform all other acts and things requisite and necessary to be done in the presence and whatsoever the said proctors or either of them shall lawfully do or cause to be done with ???? I do hereby promise and engage to ratify and confirm.

In witness whereof, I have hereunto set my hand, sealed this twenty first day of January in the forty second year of the year of our Sovereign Lord George the third by the grace of God of the United Kingdom of Great Britain and Ireland, King defender of the faith in the year of our Lord one thousand eight hundred and two
