Will of John Shepherd of Wimeswold 1832

This is the Last Will and Testament of me John Shepherd

Of Wimeswold in the County of Leicester Farmer and

Grazier. First I Will and Direct that all my just debts

Promises

Will be payed out............ as soon as conveniently

May be after my decease.................. hereinafter

Named. I give and bequeath unto my son John the
Legacy or sum of Four hundred pounds to be paid
To him within twelve months next after my decease.

 

1. I Also give and bequeath to my daughter Elizabeth the Legacy
or Sum of Five Hundred pounds to be paid to her within twelve
months next after my decease. I also give and bequeath to my
said daughter the Bed called her Mothers Bed with Furniture and
every thing thereto belonging. Also I give and bequeath to her
daughter Martha the Legacy or sum of Five Hundred pounds to
be paid to her within twelve months next after my decease. I also
give to my said

2. daughter Martha the Bed called the Best Bed with
Furniture and every thing thereto belonging and my mind
and will is that in case either of my Said daughters shall
depart this life before her Legacy shall become due and
payable without bearing issue lawfully begotten Then I
direct that the Legacy of her so dying shall go to her Sister
and be paid to her at the same time as her own original
Legacy as before directed to be paid and subject And
charged and chargeable with the before mentioned
Legacies. I give devise and bequeath unto my Son
William all and every my Real and personal Estate
Whatsoever and wheresoever and of what nature or

kind soever. To Hold to him my said son William his
heirs, Executors, administrators and assigns for ever
according to the nature and tenure thereof.
Provided always and my mind and will is that
In case my said son William shall depart this life
In my life time without bearing issue lawfully
begotten Then I give and devise all my said Real
and personal estate except as aforesaid and subject
to the before mentioned Legacies to my said Daughters     

and my said son John and my Grandson John
.........        in equal shares and proportions and as to

my Real Estate be held to them their heirs and

assigns for ever and to take as Tenants in Common

and not as joint Tenants. And lastly I do

hereby I do hereby nominate constitute and appoint my said

son William sole Executor of this my Will and

do hereby revoke all former and other Wills by

me at any time herebefore made. In Witness whereof

I have hereunto set my hand and seal this eleventh

day of January one thousand eight hundred

and thirty two.

Signed sealed and published and declared by the said John Shepherd
the Testator as and for the last Will and Testament in the presence of
us who in his presence at his request and in the presence of each
other have hereunto subscribed our names as witnesses

6 Decr. 1832

This is the Codicil deponed by the

Executor on that day

I  John Shepherd of  Wimeswould in the County of

Leicester, Farmer, do hereby declare this to be a

Codicil to my last Will and Testament. Whereas I

have in and by my said Will given and bequeathed

to my Son John the Legacy or Sum of Four Hundred pounds

and after bequeathing several legacies in manner in

my said Will particularly mentioned have given and

bequeathed to my son William the Residue of my

personal Estate. Now I do by this Codicil give and

bequeath to my son John in addition to what is

given to him by my said Will, the narrow wheel

waggon that was made by Waterfields with the

raiths and side board, a narrow wheel cart,

two of my cart horses and tackle for two

horses and except as far as I have by this

Codicil altered the same I do hereby ratify and

confirm my said Will. In Witness whereof I Have

hereunto set my hand and Seal this thirtieth

day of July one thousand eight hundred and

thirty two.

I John Shepherd do request that my said Executor William Shepherd

Do and shall permit and suffer my Daughters Elizabeth and

Martha Shepherd to occupy the little Cottage house and for them to pay my said Son

William the yearly Rent of Three Pounds and three shillings and every year so long as they

shall occupy the and rent it ....................... by above Codicil

made and added to the above Codicil by the said John Shepherd
