Discotheque = Tiny Twisters Disco

Promoter = The Person who made the booking and is responsible for payment

1.  In the event of the DISCOTHEQUE agreeing to be paid a percentage of the admission 
money, the PROMOTER must provide the DISCOTHEQUE, or his representative, with a 
written statement of  the full details of ticket numbers, admission prices and the number of 
patrons and also provide full facilities for the checking of same.

2.  In the event of the PROMOTER wishing to cancel a booking any deposit   that  has 
been paid will be forfeit.  If  the cancellation is made within 7 days of the performance 
date full payment will be applied for by the DISCOTHEQUE.

3.  The DISCOTHEQUE will use its best endeavours to attend the function, or  provide an 
alternative discotheque to give satisfactory performance. Should the DISCOTHEQUE be 
prevented from attending for any reason outside its control, including wrong venue address, 
mechanical breakdown, road closures and the like, the DISCOTHEQUE or Tiny Twisters  
shall not incur any liability for  its non-appearance.

4.  Licences for the performance of recorded music are only required at public events.  In most 
cases private parties (invitation only - no entry fee), do not require a licence.  
However, it is the PROMOTERS responsibility to  ascertain whether a licence is required 
and it is his / her responsibility to obtain such licences.  Should the DISCOTHEQUE be prevented 
from performing due to the failure of the PROMOTER to obtain any appropriate licence, or similar 
permission, or should the performance be cancelled for

any reason other than covered in clause 3 above, then the provisions relating to cancellations as 
set out in clause 2 above shall be deemed applicable.

5.  The PROMOTER will allow / arrange for the DISCOTHEQUE to have adequate setting up time 
prior to the performance time and sufficient time afterwards to dismantle and remove the 
equipment from the venue.  If, at the request of the PROMOTER, any equipment, included 
recorded music, is to be left at the venue then the PROMOTER will assume sole responsibility 
for the

safe-keeping of the equipment and will be liable for any losses or damages, however caused, 
during such time as the equipment is at the venue.

6.Should the equipment be left at the venue at the PROMOTERS request and should 
circumstances arise preventing the DISCOTHEQUE from gaining access to the venue, in 
order to remove the equipment, at a mutually agreed time, through no fault of the 
DISCOTHEQUE, then the PROMOTER will be liable for additional expenses to cover further 
appointments to effect removal.  Furthermore, if the DISCOTHEQUE is prevented from 
carrying out other  engagements due to being unable to collect the equipment, the PROMOTER 
will be liable to any expenses or loss of earnings thus incurred by the DISCOTHEQUE.

7.  The PROMOTER will provide adequate supervision of all guests and/or staff and/or customers 
at the venue and will be liable for any loss of or damage to the equipment caused by anyone 
other than the DISCOTHEQUE personnel.

8.  The PROMOTER warrants that he/she is entitled to use the venue for the  purposes 
of the event and performance.

9.  In places of public entertainment the PROMOTER will provide facilities where the 
DISCOTHEQUE personnel may rest or change prior to, during and after the performance.

10. The DISCOTHEQUE personnel will conduct themselves in a manner becoming to  
the engagement and will respond to the PROMOTERS requests as to dress code, volume levels, 
music played, equipment siting and/or any other reasonable request.

11. Where applicable, the PROMOTER will permit the DISCOTHEQUE to display its advertising 
material at the venue prior to and during the performance.

12. The DISCOTHEQUE will in no way be liable for any breach of laws, bye-laws or conditions 
under which any premises or property are entrusted, leased, hire to, or owned by the promoter.

13. The DISCOTHEQUE will expect access to properly earthed mains electricity supply of 
sufficient amperage to allow safe usage of the required equipment for the performance.  
If , in the opinion of the DISCOTHEQUE, the mains supply is inadequate then the 
DISCOTHEQUE may reduce the amount of equipment accordingly without prior consultation 
with the PROMOTER. If, in the opinion of the DISCOTHEQUE, the mains supply is unsafe, 
then the DISCOTHEQUE will reserve the right to refuse to perform. This will only be done 
after consultation with the PROMOTER and the DISCOTHEQUE proving the mains to be unsafe.

14. The balance of the engagement fee payable by the PROMOTER to the DISCOTHEQUE 
must be paid to the DISCOTHEQUE in cash prior to the start of the performance. Cheque 
and credit card payment may only be made in advance and by prior arrangement.

15. Any extension of playing times is purely at the discretion of the DISCOTHEQUE as 
sometimes it is not possible to extend times due to other arrangements. The fee for extending
 times will be advised on the contract.

16.  Tiny Twisters is merely acting as an arrangement agent for the Promoter and accepts 
no liability for loss or damage however caused

18. The PROMOTER engaging the DISCOTHEQUE and the DISCOTHEQUE accepting

the engagement confirms acceptance of all the terms and conditions by all involved parties.
