This Blog was first written in April 2005 and tells the story of a Road Rage incident on Dundee's Kingsway. The event itself was an all-too-common example of bad behaviour on our roads. But what followed was quite out of the ordinary. From the moment the police became involved, followed by solicitors and the courtly administrators of the
procedures that are supposed to bring about Justice, I felt as if I was an extra aboard Douglas Adams' wholly remarkable space ship - the one powered by an Improbability Drive that gets the crew out of many a tight spot.

The recent Shirley McKie and Al Megrahi reviews, which highlighted endemic corruption in the Scottish Injustice System, have persuaded me to revise my view of the role of the prosecution in the case blogged on these pages. I now believe that it acted corruptly in bringing the case. The prosecution submitted corrupt evidence and it withheld evidence. If it was unaware of it, that is because it never bothered to make any checks. It is no defence to claim ignorance - a public body such as the Procurator Fiscal service has a duty to actively ensure that no part of its case is tainted. If high profile cases cannot manage this, there is a high risk that minor cases could also be full of corrupt evidence.
